The New Irish Pressure Systems Regulations has Arrived!

Safety, Health and Welfare at Work (General Application) (Amendment) Regulations 2012 (S.I. No. 445 Of 2012).

The final version of the above amending regulations to the Safety, Health and Welfare at Work (General Application) Regulations 2007 (as amended) has completed its parliamentary passage and became law on 1st January 2013.

The result of this new legislation is to insert a ‘Part 10 – Pressure Systems’ and ‘Schedule 12’ within the General Application Regulations and together with the Safety, Health and Welfare at Work Act 2005 (Commencement) Order 2012 (which also became effective on 1st January 2013), will mark an important change in health and safety law within Ireland.

This will have a significant impact on employers and owners of pressure equipment and systems. Sections of the Factories Act 1955 (s.40, 41, 42 and 43) and subsequent regulations made under this Act which relate to steam boilers, steam receivers and air receivers have been revoked and a much more comprehensive and updated framework for pressure equipment and pressure system safety put in place, including regular examination by a ‘Competent Person’.

There is no longer a focus on steam boilers, their associated receivers and air receivers that are used within a factory as defined by the Safety in Industry Acts, but any pressure system that contains what is termed a ‘relevant fluid’ and used within any workplace will potentially fall within the jurisdiction of the new legislation.

A ‘relevant fluid’ is defined as:

steam,
any gas greater than 0.5 bar(g) or;
pressurised liquid with a vapour pressure greater than 0.5 bar(g) at its operating temperature or 17.5°C. There are a number of noteworthy exceptions to the Part 10 Regulations contained within

Schedule 12 Part A – a few of these are identified below:

any pressure system containing a relevant fluid (other than steam), if the product of the pressure (in bar) and internal volume (in litres) of its pressure vessels is, in each case, less than 250 bar litres
vessels designed to contain liquids with a gas pressure above the liquid of not more than 0.5 bar
any part of a tool or appliance designed to be held in the hand which is a pressure vessel
vapour compression refrigeration systems incorporating compressor drive motors, including standby compressor
motors, having a total installed power not exceeding 25 kW
pressure systems and equipment intended for the functioning ofa wheeled, tracked or rail mounted vehicle, such as equipment forming part of any braking, control or suspension system
hydraulic systems in work equipment, except for gas-charged.
